GENERAL TERMS AND CONDITIONS

GENERAL TERMS AND CONDITIONS

The General Terms and Conditions (hereinafter referred to as „Terms“) of Albeřické chalupy (hereinafter referred to as „Cottages“) regulate the mutual contractual relationship between the operator of the Cottages – Tomáš Váňa, Národní 924, 551 01 Jaroměř, IN 63190141, VAT ID CZ6801060794 (hereinafter referred to as „Operator“) and the client – a natural or legal person who orders a stay at the Cottages as a purchaser (hereinafter referred to as „Purchaser“). These terms apply generally to all guests of the Cottages.

The General Terms and Conditions (hereinafter referred to as „Terms“) of Albeřické chalupy (hereinafter referred to as „Cottages“) regulate the mutual contractual relationship between the operator of the Cottages – Tomáš Váňa, Národní 924, 551 01 Jaroměř, IN 63190141, VAT ID CZ6801060794 (hereinafter referred to as „Operator“) and the client – a natural or legal person who orders a stay at the Cottages as a purchaser (hereinafter referred to as „Purchaser“). These terms apply generally to all guests of the Cottages.

1. ACCOMMODATION RESERVATION

Accommodation reservation at the Cottages can be made through the reservation system on the website https://www.alberickechalupy.cz/, or by directly contacting via email or phone using the Operator’s contact details.

A reservation is valid and binding once the Cottages confirm the reservation to the Purchaser or in the case of automatic email confirmation generated by the respective online reservation system. The accommodation contract is concluded upon payment of the reservation deposit. The reservation deposit is due no later than 7 days from the invoice date for the reservation deposit. The reservation deposit is 50% of the accommodation price.

All information stated on the reservation confirmation is binding for both parties.

The price is stated for 10 persons, except for stays of a week for 6 persons unless otherwise specified in these Terms or agreed upon by the contracting parties. The accommodation price includes VAT at the applicable current rate, use of bed linen, towels, outdoor grill and fireplace, wood, and water consumption. The listed accommodation prices apply only to direct bookings made through our website or email. These prices do not apply to stays booked via the booking.com portal.

Family for a Week – weekly stay (Saturday-Saturday)

  • CZK 25,620 / week / 6 persons - from CZK 610 / person / night
  • We will be happy to prepare an offer for you!

Two Families for a Week – weekly stay (Saturday-Saturday)

  • CZK 35,000 / week / 10 persons - from CZK 500 / person / night
  • Each additional person: CZK 500 / person / night (up to a maximum of 15 persons)
  • We will be happy to prepare an offer for you!

Short Stay – short-term stay

  • CZK 12,000 / week / 10 persons - from CZK 600 / person / night
  • Each additional person: CZK 600 / person / night (up to a maximum of 15 persons)
  • We will be happy to prepare an offer for you!

Easter (Green Thursday – Easter Monday)

  • CZK 25,000 / 4 nights / 10 persons
  • Individual offer (up to a maximum of 15 persons)

Christmas (December 22 – December 26)

  • CZK 42,000 / 4 nights / 10 persons
  • Individual offer (up to a maximum of 15 persons)

New Year (December 27 – January 2)

  • CZK 60,000 / 6 nights / 10 persons
  • Individual offer (up to a maximum of 15 persons)

The accommodation price does not include the recreational fee to the municipality, which is CZK 20 / person / night. The recreational fee does not apply to children (persons under 18 years of age) and DID. 

Reservations can be canceled only in writing via email. 

Changes to the accommodation reservation to another date are possible only by agreement with the Operator.

Accommodation is generally paid by bank transfer. Payment in cash is possible only by prior agreement with the Operator.

The accommodation price does not include a refundable deposit of 5,000 CZK / stay and the payment for electricity consumption, which equals the difference between the initial and final meter readings at CZK 6 / kWh.

3. CANCELLATION POLICY

No cancellation fees are charged if the reservation is canceled up to 30 days before the Purchaser’s arrival date. The Purchaser is required to deliver written notice of cancellation to the Operator (by email).

If the reservation is canceled 30 days or less before the arrival date, a cancellation fee of 50% of the accommodation price is charged.

If the reservation is canceled less than 14 days before the arrival date, a cancellation fee of 100% of the accommodation price is charged.

In the event of force majeure, where the Purchaser is demonstrably unable to use the reservation, such as due to illness (either their own or a family member's) or due to COVID-19 restrictions on the Purchaser’s side (mandated quarantine, etc.), the Cottages' right to the cancellation fee is unaffected.

If the Purchaser cannot use their accommodation reservation due to conflicts with current prohibitions and regulations of the Government of the Czech Republic, other state authorities due to COVID-19, or obstacles on the Cottages' side, the Purchaser has the right to cancel the stay without a cancellation fee and to receive a refund of previously paid deposits.

4. RIGHTS AND OBLIGATIONS OF THE PURCHASER

The Purchaser has the right to use the reserved accommodation space, including equipment. They also have the right to use the common areas. The Purchaser and other guests must comply with the Cottages' house rules, which are physically located inside the Cottages and are also accessible via the button below.

The Purchaser is responsible for any damages caused during the stay and agrees to pay for any necessary repairs, replacements, or special cleaning costs. Damage costs will be determined by the Operator.

Any defects and deficiencies must be reported by the Purchaser to the Operator during their stay for rectification.

Check-in on the day of arrival is from 16:00. If the Purchaser needs to check in earlier, this can be done only by prior agreement with the Operator.

All indoor areas of the Cottages are non-smoking. Violation of this rule entitles the Operator to charge a contractual penalty of CZK 5,000, which the Purchaser is obliged to pay. This violation also entitles the Operator to immediately terminate the stay. Smoking is allowed outside the Cottages in designated areas, which are marked. The above also applies to electronic cigarettes and similar devices. The use of drugs or other illegal narcotic and psychotropic substances is prohibited throughout the Cottages.

The Purchaser and other guests are required to keep and leave the cottage in a clean and original condition. For maintaining a home environment, please change shoes at the entrance to the cottage. It is forbidden to walk inside the Cottages in ski, cycling, or other sports shoes, or with crampons, etc. 

Please do not flush sanitary products (wet wipes) down the toilet.

It is forbidden to throw waste outside designated areas (waste bins) or otherwise pollute the Cottages' premises. A waste container is located outside the Cottages, and waste must be disposed of at the designated place. The area for sorted waste is in the sports equipment storage. 

It is not allowed to move furniture, equipment, make any modifications, or interfere with the electrical network and other installations. Furniture from the Cottages cannot be moved to outdoor areas either.

The Operator will instruct guests on the use of electronics, the outdoor grill, the fireplace, tiled stove and cooker, and the sports equipment storage.

Upon leaving the cottage, the Purchaser is responsible for checking electrical appliances (turning off the electric oven, hob), turning off lights, closing all windows, and locking the sports equipment storage. 

The Purchaser must ensure that the building is always locked from all entrances when leaving. In case of key loss, the Purchaser agrees to pay the Operator a contractual penalty of CZK 1,500.

Before departure, guests must turn off all cottage appliances, empty the refrigerator, and wash dishes (empty/load the dishwasher). Above-average cleaning is not included in the standard cleaning fee, e.g., mud on the floor, dirty refrigerator, unwashed dishes (dishwasher not turned on/emptied), dirty walls, mess, and garbage around the cottage, etc. If not put in order, a contractual penalty of CZK 2,000 will be charged and paid in cash before departure to the Operator.

The Purchaser must take extra care when handling fire and follow all safety instructions and general regulations. Open fires are only allowed in the outdoor fireplace designated for this purpose. The fireplace must always be extinguished when leaving. The Purchaser must ensure that the stove and cooker doors are always closed. 

Extra attention is needed on the interior stairs, as the steps may be slippery, posing a risk of injury. The same caution is needed on the terrace and garden, where many stones and inventory are located.

Everyone present must immediately report the risk of fire, situations requiring police intervention, or medical treatment, and do everything possible to prevent the spread of fire or avert impending danger.

Quiet hours are from 10 PM to 6 AM. Please avoid activities that excessively disturb the surroundings, contradict good manners, or disturb neighbors.

The Purchaser must have a charged phone available during their stay in case of need.

The Purchaser has the right to use the reserved accommodation space, including equipment. They also have the right to use the common areas. The Operator is obliged to provide the Purchaser with accommodation based on pre-agreed terms and payment.

The Operator has the right to request the Purchaser to leave the accommodation in the Cottages if the Purchaser or other guests behave against common societal rules or demonstrably damage the Cottages' equipment.

6. COMPLAINTS, CLAIMS, DISPUTE RESOLUTION

Complaints and comments of the Purchaser regarding the contractual relationship between the Purchaser and the Operator are handled by the Operator. Complaints can be made by the Purchaser at info@alberickechalupy.cz.

If the complaint is in the nature of a claim, it will be handled as a claim. Clients can also address their complaints to supervisory and state control authorities, such as the Czech Trade Inspection Authority or the Office for Personal Data Protection.

All legal disputes arising in connection with the accommodation contract will be resolved in civil proceedings by the general courts of the Czech Republic. The client, as a consumer, also has the right to out-of-court settlement. The entity for out-of-court settlement according to Act No. 634/1992 Coll., on Consumer Protection, is the Czech Trade Inspection Authority. All details regarding out-of-court settlement are provided on the website of the Czech Trade Inspection Authority at www.coi.cz.

Complaints and comments of the Purchaser regarding the contractual relationship between the Purchaser and the Operator are handled by the Operator. Complaints can be made by the Purchaser at info@alberickechalupy.cz.

The Operator collects the Client's personal data in accordance with GDPR principles to the extent necessary for fulfilling legal and contractual obligations.

By paying the deposit, the Client agrees to these terms and conditions. We look forward to seeing you.

These General Terms and Conditions were issued on April 20, 2024, and are effective as of May 1, 2024.
